"Vorbe" or "VorbeAI"means the online automatic audio and video transcription platform, available at https://vorbe.ai, operated by Digital Radia Spark SRL.

"Provider"means Digital Radia Spark SRL, a Romanian legal entity, identified by the information in the "General Information" section.

"User"means any natural or legal person who creates an account, accesses, or uses Vorbe services.

"Service"means the set of functionalities offered through the Vorbe platform, including, but not limited to, automatic audio and video transcription, speaker identification, summary generation, and transcription export.

"User Content"means any audio file, video file, text, document, metadata, or information uploaded, transmitted, or generated by the User through the Service, including resulting transcriptions.

"Account"means the profile created by the User on the Vorbe platform, required to access the Services.

"Subscription"means a paid or free access plan, for a fixed or indefinite period, that allows the use of certain Service functionalities.

"Trial Period"means the time interval during which the User can use certain Service functionalities for free, according to the conditions communicated on the website.

"Terms" or "Terms and Conditions"means this legal agreement, including any subsequent updates thereto.

"Privacy Policy"means the document available on the Vorbe website that describes how Users' personal data is processed.

These Terms govern access to and use of the VorbeAI website and services.

2. Service Description

VorbeAI provides automatic transcription services based on artificial intelligence, including but not limited to:

Audio and video transcription

Speaker identification

Automatic summary generation

Export of transcriptions in editable formats

The service is provided "as is" and may be modified, updated, or extended periodically without obligation for individual notification.

3. Eligibility and Use

To use VorbeAI:

You must be at least 18 years old

You must use the service in accordance with the law

Use of the platform for illegal, abusive activities or activities that infringe the rights of third parties is prohibited

We reserve the right to suspend or restrict access to the service in case of improper use or violation of these Terms.

4. Transcription Accuracy

VorbeAI uses artificial intelligence technologies to process audio and video content.

We do not guarantee absolute accuracy of generated transcriptions.

The user is responsible for manually verifying transcriptions before use, especially in legal, professional, or official contexts.

VorbeAI does not provide legal advice and cannot be used as a substitute for human verification or interpretation.

5. User Content

5.1 Content Ownership

All audio files, video files, transcriptions, and generated documents:

Remain the exclusive property of the user

Are not used for training artificial intelligence models

Are not sold, shared, or commercially exploited by VorbeAI

5.2 Limited License

By using the service, the user grants VorbeAI a limited, non-exclusive, non-transferable, and temporary license to process the content strictly for the purpose of providing the contracted services.

6. Privacy and Security

User data is processed in accordance with the VorbeAI Privacy Policy, VorbeAI Cookie Policy, and VorbeAI Data Sub-Processors List, which are an integral part of these Terms and Conditions.

7. Subscriptions, Payments and Refunds

VorbeAI services are digital services provided online, the execution of which begins immediately after payment confirmation.

Certain features may be accessible on a subscription basis:

Payments are made in advance

Subscriptions can be canceled at any time, effective at the next billing period

Refund Policy

In accordance with EU consumer protection regulations, the 14-day right of withdrawal does not apply to digital services whose provision has begun with the express consent of the consumer.

By making a payment and using VorbeAI services, the user:

Expressly requests the commencement of service provision before the expiry of the withdrawal period

Confirms that they have been informed and accepts the loss of the right of withdrawal and refund once service provision begins

Therefore, payments made are non-refundable, except in situations expressly provided by law.

8. Intellectual Property Rights

The VorbeAI platform, including source code, design, logos, and visual elements, is the property of Digital Radia Spark SRL.

The following are strictly prohibited without prior written consent:

9. Limitation of Liability

The service is provided "as is" and "as available".

VorbeAI is not liable for:

Indirect or consequential losses

Transcription errors

Data loss

Use of transcriptions without human verification

To the extent permitted by law, VorbeAI's total liability is limited to the amount paid by the user for the service.

10. Suspension and Termination

We reserve the right to suspend or close accounts:

In case of Terms violation

For illegal activities

For protecting platform security

Where possible, users will be notified in advance.

11. Modification of Terms

We may update these Terms periodically.

Significant changes will be communicated at least 30 days before they take effect.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania.

Any disputes will be resolved by the competent courts in Romania.
